Customer agreement
Terms and Conditions.
These Terms and Conditions outline the rights and obligations between you (“Customer”, “You” or “Your”) and Popit Mobile (“We”, “Us” or “Our”) regarding the provision of mobile phone services. By subscribing to our services, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.
1. Service provision and usage
1.1 We will provide you with mobile phone services as a Mobile Virtual Network Operator within the United Kingdom.
1.2 The services provided include voice, messaging and data services, subject to coverage and network availability in your area.
1.3 The contract duration is 30 days and will automatically renew unless cancelled by either party.
1.4 You must be a UK resident and predominantly reside in the United Kingdom.
2. Cancellation of contract
2.1 You have the right to cancel the contract before the end of each 30-day billing period.
2.2 You may cancel the contract by providing us with a written request or, once available, by requesting a cancellation code from your subscription details in My Account.
3. Data usage and fair usage
3.1 The data allowance specified in your plan is for domestic use within the United Kingdom, except where your package expressly includes roaming usage.
3.2 We may apply a Fair Usage Policy to prevent abuse or excessive usage and to help ensure a fair experience for all customers.
3.3 Excessive or abusive data usage may result in a temporary reduction in data speeds or other action we consider necessary.
4. Service limitations and liability
4.1 We strive to provide reliable and uninterrupted services. However, services may occasionally be unavailable because of maintenance, network issues or other factors beyond our control.
4.2 We will not be liable for damages or losses resulting from service unavailability or interruption, except where caused by our negligence or breach of this Agreement.
4.3 We will not be liable for direct, indirect, incidental or consequential damages arising from the use of, or inability to use, our services.
5. Termination
5.1 We reserve the right to terminate your services immediately and without notice in the event of:
- a breach of these Terms and Conditions;
- non-payment of fees or charges; or
- misuse of services or violation of applicable law.
5.2 Termination of services does not release you from outstanding financial obligations or liabilities under this Agreement.
6. Privacy and data protection
6.1 We will handle your personal information in accordance with our Privacy Policy, which is included on this page.
6.2 By using our services, you acknowledge the collection, use and disclosure of your personal information as outlined in our Privacy Policy.
7. Changes to these Terms and Conditions
7.1 We reserve the right to modify or amend these Terms and Conditions.
7.2 Changes will be communicated through our website or by other suitable means.
7.3 Your continued use of our services after the effective date of a change constitutes acceptance of the amended Terms and Conditions.
8. Postage and delivery
8.1 Delivery of physical items, including SIM cards and related materials, will be carried out by first-class recorded postage.
8.2 We will not be responsible for delivery delays caused by postal or courier services.
9. Payment information
9.1 Auto-renewal starts upon activation of your SIM card.
9.2 Your billing date will occur three days before your data package renewal.
9.3 You will not be able to change your package between the billing date and data-renewal date.
9.4 Failure to pay for renewal without contacting us to cancel may result in an administration fee of 2% above the UK banking rate.
9.5 American Express cannot be used because we are classified as a prepaid mobile, telecommunications or IT service.
10. Hardware support
10.1 We do not provide hardware support. Issues relating to your mobile device should be directed to the device manufacturer or an authorised service centre.
11. Returns and cooling-off rights
11.1 You may notify us that you wish to cancel this Agreement, without giving a reason, within 14 days beginning the day after this Agreement starts or you receive your SIM card (“Cooling-Off Period”). You will not receive a refund of free airtime credit received from us, if any. You agree that use of the services may begin before the end of the Cooling-Off Period.
11.2 If a SIM obtained from us is defective, please contact us.
11.3 This clause does not affect legal consumer rights that cannot be limited under English law. Contact Trading Standards or Citizens Advice for more information about your rights.
12. Acceptable Use Policy
12.1 Services are provided on the condition that:
- you do not use them fraudulently, criminally, unlawfully, improperly, offensively, abusively, in a defamatory, obscene or menacing manner—including towards our staff—or in breach of confidence, copyright, privacy, intellectual-property or other third-party rights;
- you comply with this Agreement, any detailed acceptable-use requirements on our website, and reasonable instructions and guidelines we provide;
- you do not cause annoyance, inconvenience or needless anxiety, or send unsolicited advertising or promotional material;
- you comply with commercially acceptable-use policies of third-party telecommunications and other suppliers, and reasonable standards normally expected over the internet;
- you use the services for private, legitimate, consumer and non-commercial use and do not resell our services;
- you use reliable equipment approved for use with the network and do not act in a way that may damage or affect the network, any system, service quality or other customers—including using GSM gateways or SIM boxes, or generating artificially inflated traffic; and
- you provide accurate personal information and promptly tell us if it changes. Otherwise, we may immediately suspend or terminate your services.
13. Governing law and jurisdiction
13.1 These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom.
13.2 Disputes arising from or connected with this Agreement will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
14. Out-of-bundle charges
14.1 Out-of-bundle charges apply while roaming, particularly to Multimedia Messaging Service (MMS). MMS is not included within unlimited calls and texts and is charged at £0.98 per message sent.
14.2 If international calling from the UK is enabled, you must monitor your wallet balance and maintain sufficient credit. Insufficient credit may restrict calls from the UK to international destinations.
14.3 When roaming beyond Zone 1, incoming calls may be chargeable. To avoid unexpected charges, monitor your Wallet Balance under Add Credit in My Account.
14.4 If you do not maintain sufficient wallet credit, we may send an email asking you to correct your account balance within seven days. Failure to comply may result in service suspension until the outstanding balance is cleared.
14.5 Customers should familiarise themselves with these conditions and use the service responsibly to avoid interruption or unexpected charges.
